Our client had an employer willing to petition her for an I-140 petition. She has a bachelor’s degree in Speech Education, a valid South Dakota teaching license, and has worked for her current employer since December 2021. Based on our client’s work history, our office determined that she is eligible for EB-3 classification for her I-140 petition. Our client retained us in October 2022.
Before filing the PERM application, our firm prepared the prevailing wage request, job order, and all other necessary pre-PERM filing steps. Within a week of our retention, the request was filed. After we obtained the prevailing wage determination, her employer filed the job order on May 8, 2023. On September 18, 2023, we filed the PERM application.
On February 3, 2024, the PERM Labor Certification was approved without an audit—an EB-3 position for the Filipina beneficiary. Our client can now file the I-140 petition at any time.
