PERM Labor Certification Approval for Canadian Oral and Maxillofacial Surgeon Beneficiary and Oral Surgery Group Petitioner in North Andover Massachusetts

Our client, who is from Canada, is currently working in the United States as an oral and maxillofacial surgeon under H-1B status. His current employer is willing to file an immigration petition for him under the second preference (EB-2). Our client holds a Doctor of Dental Medicine degree from a United States institution and has completed a four-year residency training program in Oral and Maxillofacial Surgery in the United States. After discussing his case, our firm concluded that his employer can petition for him as an Oral and Maxillofacial Surgeon. Based on our client’s educational, professional, and work history, our office determined that he is clearly eligible for EB-2 classification.

Prior to filing the PERM labor certification, our firm prepared the prevailing wage request, job order, advertisements, internal job posting, recruitment report, and all other necessary pre-PERM filing steps. Please note that PERM could be filed at least 60 days after the job posting date or 30 days after the last advertisement. The prevailing wage request was filed on August 24, 2022. After we obtained the Prevailing Wage Determination, the Petitioner filed the job order on July 24, 2023. On October 26, 2023, we promptly filed the PERM labor certification, which was eventually approved on April 9, 2025, for an EB-2 position for our Canadian beneficiary. Now, our client can file the I-140 petition.
