CASE: Marriage-Based Adjustment of Status

Our client is from the Philippines who came to the U.S. on a J-1 exchange visitor’s visa in February 2020. His J-1 visa program was not subject to the two-year foreign residency requirement. In October 2021, our client is married his current U.S. citizen wife. He retained our office on December 30, 2021, for his green card application. Our firm prepared and filed the I-130 Petition and Adjustment of Status Application on January 13, 2022. Everything went smoothly and the receipt notices and fingerprint appointment all came on time. However, on October 21, 2024, the USCIS issued the Request for Evidence (RFE) and requested our client to submit more bona fide marital documents with his U.S. citizen spouse. Our office filed his Response to RFE on October 29, 2024. Nevertheless, the USCIS scheduled the interview for his adjustment of status application. Prior to the interview, we thoroughly prepared our clients at our office via conference calls. On January 15, 2025, our client was interviewed at Kansas City, MO USCIS office. Eventually, on January 17, 2025, his green card application was approved.
