CASE: I-751 / Waiver of the Joint Waiver Requirement
APPLICANT: Kenyan
LOCATION: Silver Spring, MD
Our client contacted our office in May 2020 regarding her potential I-751 filing. She is from Kenya and she married a U.S. citizen in May 2015. She obtained a 2-year conditional green card in January 2016 through her marriage with her U.S. citizen spouse. Therefore, her conditional residency was terminated in January 2018.
Unfortunately, during their marriage, our client and her ex-husband went through struggles. They lived separately for a while and their divorce was finalized. Thus, our client could not file an I-751 application jointly with her ex-husband. Moreover, she failed to file her I-751 application on time. We advised that we could help her file the I-751 by waiving the joint filing requirement. We requested a waiver because our client entered the marriage in good faith, but the marriage was terminated through divorce or annulment before they could file a joint petition.
On May 28, 2020, our office filed the I-751 application with supporting documents to demonstrate our client’s bona fide marriage with her ex-husband. On January 9, 2024, the USCIS approved her I-751 application. Now, she has her ten-year green card.
