I-751 Approval for Filipina Client in Los Angeles California with Waiver of Joint Filing Requirement due to Divorce

Our client contacted our office in February 2022 regarding her I-751 filing. She is from the Philippines and married a U.S. citizen in May 2019. Through her marriage, she obtained a 2-year conditional green card in May 2020. Her conditional residency terminated in May 2022.

 

During their marriage, our client and her ex-husband went through struggles They lived separately for a while and their divorce finalized in March 2022. Thus, our client could not file I-751 with her ex-husband. We advised that we can help her file the I-751 application with a waiver of the joint filing requirement. We requested a waiver because our client entered the marriage in good faith, but the marriage was terminated through divorce before they could file a joint petition.

 

On April 12, 2023, our office filed the I-751 with supporting documents to demonstrate our client’s marriage with her ex-husband. 

 

In May 2, 2024, the USCIS issued Request for Evidence for our client to submit more marital evidence. Our office filed the Response to RFE on May 9, 2024. On May 14, 2024, the USCIS approved her I-751 application. Now, she has her ten-year green card.
