CASE: Marriage-Based Adjustment of Status

Our client came to the United States from the Philippines with a B-2 visitor’s visa in August 2019. Thereafter, he stayed in the United States even after his B-2 authorized stay period expired. He married a U.S. Citizen in October 2022. He retained our office for his green card application on November 10, 2022. Our firm filed the I-130 Petition and I-485 Application on December 1, 2022. All went well and the receipt notices, fingerprint appointment, and work permits came on time. However, on August 4, 2023, the USCIS issued a Notice of Intent to Deny and requested our client to submit his bona fide marital evidence with his U.S. citizen spouse. Our office filed our client’s response to NOID with numerous bona fide marital evidence on August 16, 2023. On August 23, 2023, our client’s green card application was approved.
