Green Card Approval Through Marriage, Visa Waiver Entry for Korean Client in Houston Texas

Our client entered the United States in August 2021 from South Korea under the visa waiver program. As a Visa Waiver Entrant, she was authorized to remain in the United States only for 90 days.  

 

Later, in December 2021, our client and her spouse married in the United States. Thereafter, her husband filed an I-130 petition for her and she also filed her I-485 application in February 2023. However, in January 2024, the USCIS denied our client’s I-485 due to the I-864 issue. 

 

She contacted our office for I-485 re-filing, and she retained our office again on February 5, 2024.  One main issue in her application through marriage was the fact that she came to the United States under the visa waiver program.   

 

Nevertheless, our office filed the I-485 Application on March 21, 2024. In October 2024, our client contacted our office again for the legal assistance of her I-130 NOID response. The NOID requested our client to submit additional marital evidence between her and her husband. Our office filed the Response to NOID on October 21, 2024. Despite the visa waiver issue, the USCIS approved her green card application on November 15, 2024.  Now, our client has become a green card holder.
