EB3 Green Card Approval for Filipino Warehouse Supervisor Beneficiary and Equipment Company Petitioner in Christiansted U.S. Virgin Islands

APPLICANT: Filipino Warehouse Supervisory Training Specialist

Our client is from the Philippines, and his prospective employer was willing to do an immigration petition for him, third-preference. He also has a Bachelor’s degree in Education. After talking to our client, our firm concluded that his employer can petition him as a Warehouse Supervisory Training Specialist. Based on our client’s working background, our office determined that he is eligible for EB-3 classification. 

 

Before filing PERM, our firm prepared the prevailing wage request and all other steps which are important to pre-PERM filing. On April 21, 2021, the prevailing wage request was filed.  After we obtained PW determination, our office filed the job order on October 9, 2021.  On February 17, 2022, we filed PERM. On October 28, 2022, the PERM Labor Certification was approved – an EB3 position for the Filipino beneficiary. 

 

We then proceeded with the I-140 Petition filing. We submitted the “ability to pay” letter for the I-140 petition, as well as the job offer letter, employer’s tax records, and other supporting documents.

 

The I-140 Petition was filed on November 22, 2022, via premium processing service. However, on December 6, 2022, the USCIS issued a Request for Evidence for our client to prove the employer’s ability to pay. Our office filed a detailed Response to RFE along with the employer’s tax record with full schedules.On March 13, 2023, the I-140 EB3 Petition for our client was approved. 

 

Once his I-140 petition was approved, he retained our office again to file an adjustment of status for him and his wife. On April 17, 2023, our office filed the I-485 applications for them. Everything went smoothly and the receipt notices and fingerprint appointment came on time. Before the interview, we prepared our client via conference calls as well. On September 13, 2024, our client was interviewed at St. Croix, USVI USCIS office. Eventually, his I-485 was approved by the USCIS on December 9, 2024.
