EB-3 I-140 Approval for Brazilian Specialty Cook Beneficiary in Brazil and Mexican Restaurant Petitioner in Hauula Hawaii

CASE: EB-3 I-140
EMPLOYER: Mexican Restaurant in Hauula, HI
BENEFICIARY: Mexican Specialty Cook in Brazil

Our client is a Mexican restaurant in Hauula, HI. They had an employee from Brazil and they were willing to petition her for an I-140 petition. Their employee had more than 2 years of experience as a Mexican Specialty cook. After talking to our client, our firm concluded that they could petition her. Our client retained us on February 9, 2022.

Before filing PERM, our firm prepared the prevailing wage request and all other steps which are important to pre-PERM filing. On March 3, 2022, the prevailing wage request was filed.  After we got the PW determination, our office filed the job order on November 9, 2022.  On February 21, 2023, we filed PERM. On May 6, 2024, the PERM Labor Certification was approved – an EB3 position for the beneficiary.

We then proceeded with the I-140 Petition filing. We submitted the “ability to pay” letter and other necessary documents for the I-140 petition. The I-140 was filed on July 18, 2024 via regular processing service. On August 12, 2024, our office filed an I-907 premium processing upgrade upon our client’s request. On August 21, 2024, the I-140 EB3 Petition for our client was approved. She can now file an immigrant visa once her priority date becomes current.
