Our client is a dental clinic located in Cleveland, Ohio. They contacted our office in May 2024 to seek assistance for their foreign employee. The beneficiary is from Argentina and obtained his Doctor of Dental Surgery degree and a dental license. The position for the Beneficiary qualifies as a specialty occupation.
The foreign beneficiary already had his H-1B visa from his previous employer. However, his visa was not expired yet, and he wanted to extend his H-1B status on the change of employer basis.
Once retained, our office filed the H-1B visa with supporting documents on May 30, 2024 via regular service. Since this petition was based on the change of employer, it was exempted from the annual cap of the H-1B. Our client’s H-1B Petition was approved on June 19, 2024. Now the Beneficiary can work for his Employer as an H-1B visa holder and he can work there for the next three years.
