EB3 Adjustment of Status I-485 Approval for Korean Taekwondo Coach in Yucaipa California

Our client is a former Taekwondo athlete, and currently works in the United States. His Taekwondo school was willing to petition him for an I-140.  Our client has a bachelor’s degree in a related field. After talking to our client, our firm concluded that his potential employer can petition him.  Based on our client’s working backgrounds, he is eligible for EB-3 classification for his I-140 petition.  Our client retained us on December 15, 2021. 

 

Before filing PERM, our firm prepared the prevailing wage request and all other steps which are important to pre-PERM filing. On December 20, 2021, the request was filed.  After we obtained foreign degree evaluation report, our office filed the job order on June 30, 2022.  On September 9, 2022, we filed PERM.  

 

On September 28, 2023, the Department of Labor issued a request for an audit. They requested documents to determine whether the recruitment process was done properly. In response, our office prepared the response to the Audit brief along with Employer’s declaration, notice of filing, and recruitment documentation on October 23, 2023.  On January 4, 2024, the PERM was approved.

 

We then proceeded with the I-140 Petition filing. We submitted the “ability to pay” letter and other necessary supporting documents for the I-140. It was filed on January 29, 2024 via premium processing service. On February 7, 2024, the I-140 EB3 Petition for our Korean client was approved. 

 

Once his I-140 was approved, he retained our office again and to file an adjustment of status for him and his wife. On February 23, 2024, our office filed the I-485 applications for our client and his wife. On June 21, 2024, our client and his wife’s adjustment of status were approved by the USCIS.
