CASE: H-1B Visa Extension Petition

Our client is a Public School District in Saint Francis, SD. They contacted our office in March 2024 to seek assistance for their foreign employee’s H-1B extension. The beneficiary obtained her Bachelor’s Degree in Elementary Education. The position for the Beneficiary is a Kindergarten Teacher which qualifies as a specialty occupation. This is because the minimum requirements for this position are a Bachelor’s Degree in Education or its equivalent.
Once retained, our office filed the H-1B visa petition with supporting documents on May 13, 2024 via premium processing service. On May 23, 2024, the USCIS issued Request for Evidence regarding the Beneficiary’s maintenance of status in the U.S. Our office filed the RFE on May 30, 2024. Our client’s H-1B application was approved on June 13, 2024. Her H-1B is good until August 5, 2027.
