In order to qualify for an I-140 petition in this category, the offered position must require at least a Master’s degree or higher, or a Bachelor’s degree plus at least five years experience. The beneficiary must possess these requirements, and the position itself as assessed by the Department of Labor must require the advanced degree and or the bachelor’s degree plus at least five years experience.
The Labor Certification is first filed, and then the I-140 Petition. If priority dates are current, the I-485 Adjustment of Status Application can be filed simultaneously, if not, the alien should wait until priority dates are current before he or she applies for adjustment of status.
